Rubenstein Wins St. Louis County Judgment in Favor of Landlord

Sarah Rubenstein recently won a judgment in a rent and possession action brought on behalf of Walmar Investment Company. Walmar brought suit in the Circuit Court of St. Louis County to regain possession of its property from a holdover tenant, Don DeFoe Flowers, Inc., and to collect several months in back rent. The tenant moved out of the property shortly after suit was filed, but alleged it was not liable for back rent pursuant to an alleged settlement agreement between the parties.

On January 31, 2012, a trial was held before Judge Ellen Ribaudo. At the close of evidence, the Judge asked for post-trial briefing on the settlement issue. Shortly after Rubenstein filed a brief on behalf of Walmar, the Judge issued a judgment in favor of Walmar for the complete amount of unpaid rent requested, as well as $7500 in attorney’s fees, and all court costs.
